2. Description of Services

Lion Menu provides a comprehensive digital ordering platform for restaurants, including:

  • QR Code Ordering System: Contactless ordering for dine-in customers
  • Online Ordering Platform: Website and mobile app ordering for delivery and pickup
  • POS Integration: Connection with existing point-of-sale systems
  • Restaurant Management Tools: Menu management, analytics, and reporting
  • Payment Processing: Secure payment handling through third-party processors
  • Customer Support: Technical assistance and account management

3. Eligibility and Registration

3.1 Eligibility

You must be:

  • At least 18 years old
  • Authorized to enter into legally binding agreements
  • Operating a legitimate food service business in Australia
  • Compliant with all applicable laws and regulations

3.2 Account Registration

To use our Services, you must:

  • Provide accurate, complete, and current information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Be responsible for all activities under your account

4. Acceptable Use

4.1 Permitted Use

You may use our Services only for:

5. Restaurant Responsibilities

As a restaurant partner, you agree to:

  • Accurate Menu Information: Provide correct pricing, descriptions, and availability
  • Order Fulfillment: Honor all confirmed orders in a timely manner
  • Food Safety: Comply with all health and safety regulations
  • Customer Service: Respond professionally to customer inquiries and complaints
  • Legal Compliance: Maintain all required business licenses and permits
  • Quality Standards: Maintain the quality and standards expected by customers
  • Delivery Coordination: Ensure timely preparation for delivery and pickup orders

6. Payment Terms

6.1 Service Fees

  • Free Plan: No monthly fees for existing POS system integration
  • Complete Solution: Low monthly fee for full POS system and maintenance
  • Transaction Fees: Standard payment processing fees apply
  • Setup Fees: One-time setup costs may apply for custom implementations

6.2 Payment Processing

  • Payments are processed through secure third-party providers
  • Transaction fees are deducted from processed payments
  • Refunds are subject to our refund policy and applicable laws
  • Disputed charges must be reported within 30 days

7. Intellectual Property

7.1 Lion Menu Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, software, and design, are owned by Lion Menu and protected by intellectual property laws.

7.2 Restaurant Content

You retain ownership of your restaurant's content (menus, photos, descriptions) but grant us a license to use, display, and process this content as necessary to provide our Services.

7.3 Trademark Usage

You may use Lion Menu trademarks only as explicitly authorized in our brand guidelines. We may use your business name and logo to identify you as a Lion Menu partner.

8. Data and Privacy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using our Services, you consent to the collection and use of information as described in our Privacy Policy.

9. Service Availability

  • Uptime: We strive for 99.9% service availability but cannot guarantee uninterrupted access
  • Maintenance: Scheduled maintenance will be announced in advance when possible
  • Updates: We may update our Services with new features or improvements
  • Support: Technical support is available during business hours

10. Limitation of Liability

To the maximum extent permitted by Australian law:

  • Lion Menu's total liability is limited to the fees paid by you in the 12 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages
  • We do not guarantee specific revenue increases or business outcomes
  • You are responsible for backing up your data and business operations

11. Indemnification

You agree to indemnify and hold Lion Menu harmless from any claims, damages, or expenses arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your restaurant operations and food service
  • Any third-party claims related to your content or business practices

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

  • Contacting our support team
  • Following the account closure process in your dashboard
  • Providing 30 days written notice for enterprise accounts

12.2 Termination by Us

We may terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activities
  • Fail to pay required fees
  • Cease restaurant operations
  • Request account closure

12.3 Effect of Termination

Upon termination:

  • Your access to our Services will be immediately suspended
  • Outstanding fees remain due and payable
  • We will provide access to your data for 30 days for export
  • Provisions that should survive termination will remain in effect

13. Disputes and Governing Law

These Terms are governed by the laws of South Australia and the Commonwealth of Australia. Any disputes will be resolved through:

  • Good faith negotiations
  • Mediation if necessary
  • Australian courts if legal action is required

14. Consumer Rights

Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law or other applicable consumer protection laws that cannot be excluded, restricted, or modified.

15. Changes to Terms
